Herod's Dungeon is an optional ability that can happen anytime during battle. Optional abilities that happen any time during battle can only take place if there are no pending triggered abilities. Another example of this is you not being able to use Unholy Writ/Magic Charms before your opponent uses Hidden Treasures.
