Title: Side Battle Initiative

When causing a side battle, I'm having a small amount of trouble determining which side has initiative in a few cases.

Case 1:
Benjamin (1/1) attacks. Gomer (3/3) bands to Astrologers (3/3). Benjamin plays Cup of Wrath, pitting Gomer against Astrologers. Attacker controls Gomer (and cannot band since her ability was already used), and Defender controls Astrologers. Which side has initiative? Is it Gomer's side because Astrologers was "the last card played" in the side battle, or Astrologer's side because Gomer's current controller was the last to play a card?

Case 2:
Benjamin attacks. Someone defends. Benjamin plays Cup of Wrath and makes Jaazaniah and Doeg (both 6/6) fight; neither was in battle already. Does the attacker or defender have initiative, or can the attacker choose what order these characters enter the Field of Battle?

Rulebook, Battle Phase, Determine Initiative: "If the characters are in a mutual destruction situation or a stalemate, then the player who did not play the last card has initiative."

REG, Side Battle, How to Play: "If both of the characters selected to fight were controlled by one of the players in battle, but neither or both of them were in a battle when they were selected, then the player that used the side battle ability decides which player controls which character in the side battle."

To add to the last paragraph that explains how to play a side battle card, the character the player who caused the side battle controls activates SAs first.  So to me, it would follow that the player who caused the side battle would also gain initiative in a stalemate or mutual destruction.  At least that's how I've played it for the past several years.

As far as I know, in a side battle all effects reactivate so Gomer would band again.

But I would say the player that activated it would choose.

I agree with STAMP, but for a slightly different reason. I've always played it that the side battle ability user decides which order the characters enter battle first (thus determining who "played" the first, and thus last card in the side battle). Either way, I think that if you want to play the first enhancement in the side battle you create into a mutual destruction, you should have that opportunity.

Side-battles have always worked exactly like that. However, with the new definition of "played," we need to just make it a hard rule.
