No, they both are discarded. There are no winners, and therefore no losers, in a mutual destruction side battles or battle challenges. The exception occurs during rescue attempts, and in this case the Hero wins the battle in a mutual destruction even though he is discarded also.

Technically there is no definition for 'losing' a side battle against another Hero (not even under Defeat), unless you are removed by Special Ability.

However, I have personally seen this played as both being captured after battle, so I'm curious to see other input.  This one could use rules clarity.

thats interesting my initial thought would be that both are losing (as in they are both dying) and therefore both should be captured
