Resurrecting Unique Heroes Already in Territory

I have 2 copies of a unique Hero in deck and 1 is in discard and the other is in territory.

If I play a resurrect ability, does having the 1 in territory restrict me from targeting the 1 in discard?

If I can target the 1 in discard, I expect it basically just stays in discard since you can't have more than 1 of the same unique Hero in play + set-aside. However, how does this affect the value of X for Emptying the Tombs?

There is a line in the Duplicate Card entry of the REG Glossary to the effect of "players cannot bring a second unique copy of a card under their control", so you can't target to the second copy and it wouldn't count towards the X.
