Herod Philip/Herod Agrippa II

If opponent is decked, and he attacks me and I block with Herod Philip to make his hero withdraw, and then I place Herod Philip beneath deck and add Herod Agrippa II to battle, is the withdrawing hero captured?  If not, I assume my opponent has special initiative to negate Philip, and Agrippa is assumed to not be in battle yet?

Herod Agrippa II - "Negate protect abilities on Fortresses. If a Hero withdraws from battle, you may capture it. May band to a Sadducee. Cannot be negated."

I can't find Herod Philip's exact ability wording.  But if opponent is decked, he returns a hero in battle to territory, and you can place Philip beneath deck to add a Herod to battle.

Withdrawing Hero would not be captured since HAII's ability was not active when the withdraw ability activated.

Your opponent would have special initiative to negate Philip.
