Interesting Case

My brother and I were playing a game today and we came across a scenario we disagreed on.

He made a rescue attempt with Ahimelek and I block with Assyrian Survivor. I then say I lose by the numbers and die and go to his territory. I then christian martyr his Ahimelek. He says that I can't do this. Either I have to let my Assyrian Survivor die and go to opponent's territory or I have CM his Ahimelek before hand and save my AS because when you lose by the numbers you are accepting defeat and you can't CM without giving a LS first.

Is this correct or is it that I can in fact die and then CM?

Your brother is correct.

If you allow yourself to die by the numbers you've willingly entered Battle Resolution, at which point dominants can't be played.

I thought that Dominants can be played any time regardless of battle outcome?  I don't think it should matter if he lost or won.  Even if he lost btn and gave up Survivor to Ahimelek.  The battle is over.  He should still be able to play CM on any hero d/t it's dominance and instant ability.  But that's just my opinion.

Allowing him to die by the numbers means you're allowing battle resolution. Battle resolution is not complete until the Lost Soul is turned over to him. Nothing can be done in between. If your character died by a special ability, you could play a dominant.

Sure, but the hero is then in territory, and it won't affect the battle since the battle is resolved.

So if you lose by numbers, then no doms, but if you lose by an enhancement you can play doms.

Correct. If you lose by a special ability, you still have many options, including interrupts, negates, Unknown Nation, Gates of Hell, dominants...

Well-stated, and agree.  There's a rule floating around in the unsearchable ether that would help clarify this, but of course I can't find it right now ;)

Everyone is correct that during battle resolution (which is gone to after each player declines to play any more cards), no abilities or doms can be used.
