Death of Unrighteous, defeated, and discard

Player A has Protection of Jerusalem in play. Player B attacks with (insert hero with abilities greater than 1/2 and that doesn't prevent evil cards here). Player A blocks with Assyrian Survivor and plays Death of Unrighteous. Does Player A get to discard an evil card with PoJ, even though Survivor is captured instead?

Protection of Jerusalem: Place in your territory: Protect your good O.T. Fortresses from opponents. When you discard an evil Assyrian from play, you may negate and discard an evil card. Limit one per territory.

Assyrian Survivor: Protected from discard abilities on opponent’s cards. If defeated, capture to opponent’s Land of Bondage. Cannot be interrupted.

Death of Unrighteous: Shuffle all Lost Souls and sites in holder's Land of Bondage into owner's draw pile. Discard all Evil Characters in battle. Errata/Play As: Shuffle all Lost Souls, sites, and evil cards in sites in holder's Land of Bondage into owner's draw pile. Discard all Evil Characters in battle.
ANB is good. Change my mind.

Prof A is correct. AS is not discarded, he's captured instead. If you played DoU on any other Assyrian you would get to use PoJ.
Have you visited the Land of Redemption today?

To start: I agree with this completely.  However, I had this ruled against me  in similar situations, and the I can see the argument on certain situations.

For example: Survivor is banded into battle (let's say he has horses, and is banded in by SoT, I think that was the situation anyway), and SSS is played.  All EC are removed, protection goes into place, and now the battle ends.  After the battle, Survivor's instead triggers, and he is captured instead of being removed.  Since SSS is a "remove to protect", the protection isn't there, and in fact, it 'never' happened, since the ruling on instead is that the original condition just never occurred once it is insteaded.

So should a soul be rescued?  I argued yes, but definitely saw the reasoning that the battle is already over, and so the opportunity has passed to rescue.  Though, with the way instead is being ruled, there was that opportunity...

So yes, this is a complicated scenario with Survivor.  Can we get some more elaboration on what happens with insteads that take place a significant time later (such as after battle)?
