David's Harp Question

I don't know the exact wording, because my computer won't let me get on the reg!  But anyways David's Harp's ability is something like "Return a Hero that is being discarded during battle back to the top of your draw pile."

Say I make a RA, and my opponent blocks with Emp. Galba "Each opponent must discard a card from hand."  If I choose to discard a Hero from hand, can I instead put them on top of my draw pile?  I would guess yes, because it fullfills David's Harp's ability (A Hero discarded during battle)

David's Harp:
Following a rescue attempt holder may select one Hero that is about to be discarded and place Hero on top of owner's draw pile.

Since you have to wait until the end of the rescue attempt, you can't rescue the hero you discarded from hand.  There may be an errata/play as restricting it a hero that was in battle, but I can't access the REG right now.

I did not mean to put my Galba discarded Hero directly on top of my draw pile, I meant after the battle phase has ended.  Because the battle would be over, and I choose the Hero that Galba discarded to be returned to the top of my discard pile then, not immediately.  Sorry for the not so good clarification!

The old REG (May 07) says the hero has to be being discarded at the end of battle, not previously discarded during battle.
