what happens if you play Disuading Speech in a side battle?

Disuading Speech: Holder may choose the Hero  his opponent uses in battle

I belive in battle refers to the battle at hand (field of battle refers to all battles going on) so you cannot switch the guy out of the main battle. And my gut says you cannot replace a hero with an EC in battle because you are using evil characters for that battle, but I am not sure 100% sure.
