For the record, it still can be used "instantly" by placing it on a Herod and then discarding it immediately.  It just can't be used without a Herod.

Just to clarify, it can be played in battle on any EC, placed on (I believe) any Herod in play, and then immediately discarded to use the withdraw special ability.

Correct.  Negating the withdraw after the capture happens would indirectly negate the capture, and the capture's can't be negated status means it can't be indirectly negated.
