can I discard Gates of Hell from territory, even if I don't have an orange brigade demon to put in battle? (or even if there isn't a battle going on?

I'd say yes to the first one. It is a "you may do x to do y". You complete x and complete as much as y as possible.
Not sure about the second one. I'd say yes.

No. You can discard it from set-aside area at any time though, regardless of what characters are in your territory or whether or not a battle is going on... ::)
