Two things:
1. Grapes gets that ability by discarding an evil card in battle, so if there are no evil cards in battle to discard, you can't get the new battle.
2. A soul is only surrendered once both players agree to move to "battle resolution" phase. At this point, you can't go back to the battle phase.
